Terms and Conditions
General & Booking Terms
- These Terms & Conditions apply to photography services provided by Bee Marie ("the Photographer") to the person or persons making the booking ("the Client").
- A booking is confirmed once the agreed booking fee/deposit has been received and the Client has accepted these Terms & Conditions.
- The booking fee secures the agreed date and time and is deducted from the total cost of the photography service.
- The remaining balance must be paid by the date stated on the Client's invoice or booking confirmation.
- Final edited photographs will not be released until the full balance and any agreed additional costs have been paid.
- Prices and inclusions will be agreed with the Client before their booking is confirmed. Any additional services or costs requested after booking may be charged separately.
- Bee Marie is based in Bristol. Travel within Bristol and Bath is included unless otherwise stated. Travel outside Bristol and Bath may incur an additional travel fee, which will be discussed and agreed with the Client before the booking is confirmed. Where applicable, additional expenses such as accommodation, parking, public transport or other necessary travel costs will also be agreed in advance.
- The Client is responsible for providing accurate information regarding the location, timings, requirements and expectations of the shoot. Significant changes to the agreed brief, location, timings or requirements may result in additional charges.
- If a re-shoot is required because important information was not provided by the Client before the session, an additional fee may apply.
Cancellations & Rescheduling
- If the Client cancels their booking more than seven days before the agreed photography date, the booking fee/deposit will not normally be refunded.
- If the Client cancels within seven days of the agreed photography date, the full agreed fee may remain payable.
- Where possible, Bee Marie may allow a booking to be rescheduled. Any payment or booking fee transferred to a new date will be at the Photographer's discretion and subject to availability.
- If Bee Marie becomes seriously ill, injured or otherwise unable to provide the agreed photography service, reasonable efforts will be made to reschedule the booking where appropriate.
- If Bee Marie is unable to fulfil the booking and a suitable alternative date cannot be agreed, payments made for services that cannot be provided will be refunded.
- Bee Marie will not be responsible for additional costs or consequential losses incurred by the Client as a result of circumstances outside the Photographer's reasonable control, to the extent permitted by law.
The Photography Session
- The Client agrees to communicate any important requirements, specific photographs, moments, people or details they would particularly like captured before the shoot or, where appropriate, during it.
- Bee Marie will make every reasonable effort to capture requested photographs but cannot guarantee that every requested image or moment will be captured, particularly during live events, weddings or other situations outside the Photographer's control.
- Clients are encouraged to discuss camera nerves, accessibility requirements, personal boundaries or anything else that may help them feel more comfortable before their session. Bee Marie will make reasonable efforts to tailor the photography experience around the Client's needs and comfort.
- The Client is responsible for obtaining any permissions required to photograph at their chosen venue or location unless otherwise agreed in advance.
- In the event of adverse weather or other conditions that make photography unsafe or impractical, Bee Marie will discuss the available options with the Client. This may include adapting the shoot, changing location or rescheduling where appropriate.
- Bee Marie cannot guarantee particular weather, lighting, backgrounds or other environmental conditions outside the Photographer's control.
Editing & Delivery
- Photographs will be selected and edited in accordance with Bee Marie's established photographic and editing style, examples of which are available through the Photographer's portfolio.
- The selection of photographs delivered to the Client is at the Photographer's professional discretion. Not every photograph taken during a session will be delivered.
- RAW and unedited image files are not included and will not be supplied.
- Clients should communicate any significant editing requirements or expectations before confirming their booking. Requests outside Bee Marie's usual editing style or requests for substantial additional retouching may incur an additional charge, which will be discussed before the work is undertaken.
- Delivery method and estimated turnaround time will be communicated as part of the booking.
Copyright & Use of Images
- Bee Marie retains copyright in the photographs in accordance with applicable UK copyright law, unless otherwise agreed in writing.
- The Client receives permission to use the final delivered photographs for the purposes agreed as part of their booking.
- For personal photography, including weddings and personal creative portraits, images may be shared and printed by the Client for personal use.
- Where photographs are commissioned for professional, promotional or commercial purposes, the permitted usage will be agreed with the Client as part of the booking where necessary.
- Final photographs should not be substantially edited, retouched or have filters applied by third parties in a way that misrepresents Bee Marie's finished work. If the Client requires an adjustment to an image, they are encouraged to contact Bee Marie first.
- Cropping or resizing reasonably required for social media or platform formatting is permitted, provided it does not materially alter the photograph.
Portfolio & Promotional Use
- Bee Marie may ask for permission to use selected photographs for the Bee Marie website, portfolio, social media, promotional materials, exhibitions, competitions or other self-promotional purposes.
- Where consent is required, the Client's preferences regarding the public use of their photographs will be respected.
- Clients are welcome to discuss privacy concerns before booking, particularly where a session is personal or sensitive.
- Any separate commercial licensing or use of photographs beyond promotion of Bee Marie's own photography services will be discussed with the Client where appropriate.
General
- Bee Marie will take reasonable care when photographing, storing, editing and delivering the Client's images. However, circumstances outside the Photographer's reasonable control, including equipment failure, file corruption, venue restrictions, weather or other unforeseen events, may affect the ability to provide particular images.
- Nothing in these Terms & Conditions is intended to exclude or limit any rights or protections that cannot legally be excluded under applicable UK law.
- Any changes to the agreed booking or these terms should be confirmed in writing.
